
Kitten Purchase Terms and Conditions
Coontastic Paws kittens are sold as-is and cannot guarantee the further development of the cats / kittens. Coontastic Paws makes no representations or guarantees of temperament, size, eye color, weight, color, or markings of kittens or cats. Coontastic Paws does not warrant the accuracy or completeness of DNA results.
By placing a deposit to hold a cat or kitten you agree to be bound by these terms and agree that you have read and understand these terms.
When purchasing a kitten you understand that regular veterinary visits are necessary for the health of the kitten. This is the responsibility of the buyer.
The buyer understands that a deposit or reservation fee to hold the kitten is a holding fee and is non-refundable unless the sale is cancelled by the Seller. Kittens are not guaranteed to be held until a deposit has been paid. If for some reason the deposit is returned, then the kitten would be made available for sale to others.
At time of pick up the kitten needs to be paid for in full. The Seller agrees to hold a kitten an additional two weeks from the advertised or agreed upon delivery date if needed. If the kitten is not picked up before this two week extension then the Buyer forfeits the deposit and the kitten will then be made available for others to purchase.
If for some reason the Buyer chooses to cancel the sale before the kitten is received the Buyer will forfeit the deposit and the kitten will be made available for sale.
If the buyer decides to rehome the kitten. The Buyer must notify the Seller and the Seller will take back the cat or kitten. The return of the cat or kitten is considered a surrender of the kitten with no refund or credit. Coontastic Paws does not accept a return of the kitten for any kind of refund for any reason. Transportation of the cat or kitten to the Breeder is the responsibility of the Buyer.
As breeders we take precautions to limit the number of problems this particular breed of cats is known for, but it is impossible to say that our cats will be free of all health issues.
This is also valid for defects established in causes outside Coontastic Paws responsibility and/or control. Coontastic Paws does not assume guarantee for hereditary defects or issues whose existence were not known or could not be known. Examples of these are luxating patella, eye or eye lid issues, polyps, hip dysplasia, cancer, and diabetes. These are examples and not a complete list. Please do your research. Buyer does not hold Coontastic Paws responsible for the health of the kitten or any vet expenses other than the health guarantee listed below.
The seller shall have completed all age-appropriate vaccinations, as determined by the seller and their veterinary team. A copy of the kitten’s health record shall be given to the Buyer at time of purchase. The seller does not warranty the cat against any adverse reactions to future vaccinations.
Seller agrees to the following (seller obligations):
1. The kitten will be examined by a licensed veterinarian.
2. Kitten will have received age-appropriate vaccinations and deworming.
3. The kitten will have a 72-hour warranty of viral and bacterial disease.
4. The Buyer will receive a breeder slip to register the kitten with TICA once proof of alteration is sent to Breeder.
The Buyer agrees to the following (buyer obligations):
1. The kitten must be examined by a licensed veterinarian within 72 hours after delivery or pickup (excluding holidays or Sundays). This is done at the Buyers expense. If this is not done within 72 hours the 72-hour viral and bacterial warranty is void.
2. The kitten is to have a healthy environment to promote health and safety. This includes fresh water at all times, quality food and keeping foreign objects from kittens reach so they will not be swallowed (this happens more than you would think).
3. Take the kitten or cat to the veterinarian in a timely manner.
4. We strongly advise the Buyer to isolate their new addition from other pets for at least two weeks. If this is a sole pet, we suggest keeping a small area for your kitten/ cat to explore so it gets used to their new surrounds and layout
5. Never declaw the cat or kitten
6. The kitten or cat is sold as an indoor cat.
7. By the time the cat or kitten reaches 9 months of age he or she should have been spayed or neutered, unless the kitten was sold for breeding.
8. To keep the cat or kitten up to date on vaccinations and deworming.
9. All medical cost are the Buyers responsibility.
10. Kittens are sold as PETS ONLY, meaning no breeding is permitted. At no time any of Coontastic Paws kittens/cats are to be used for breeding without express written consent/registered consent of Coontastic Paws a fee of $3,000.00 is to be paid to Coontastic Paws immediately.
Not complying with the buyer obligations will terminate all Seller warranties and release Seller of any obligation to the Buyer.
Additional Obligations for Breeders:
1. The Buyer must review parents DNA results of the kittens parents (will be given upon request and or emailed to buyer) before purchasing. By purchasing or placing a deposit indicates you are happy the parents DNA reports.
2. Buyer must complete all desired health testing before mating.
3. All cost associated with breeding, health testing, and veterinary cost are the Buyers responsibility.
Not complying with the buyer obligations will terminate all Seller warranties and release Seller of any obligation to the Buyer.
HEALTH GUARANTEE ON KITTENS:
1. The seller warrants the kitten to be free of viral and bacterial diseases for 72 hours after transfer. If the kitten is found to have a viral or bacterial disease the Seller will reimburse the Buyer reasonable cost for the treatment. Buyer must notify Seller within 24 hours of diagnoses. Paid receipts from a licensed veterinarian will be required. If the Seller determines cost of care to be unreasonable the Seller has the right to get a second opinion of a veterinarian of the Sellers choice. Buyer is to release the Seller to speak to Buyers veterinarian directly.
2. If the kitten is to pass way from a hereditary, congenital (other than death resulting from the Buyers fault or neglect) with in the kittens first year of life, Seller will replace the kitten as long as the Buyer has met all Buyer obligations. Covered conditions are only conditions in which can be tested for from a DNA test. Diseases and conditions in which can not be tested with the optimal solution wisdom panel will not be covered.
3. Seller will not warranty what the Seller can not control. This includes environmental diseases such as Feline Leukemia or Rabies, preventable illness, accidents, injury, ingestion of objects, or illness or injury resulting from Buyer failing to fulfill Buyers obligations.
4. Reimbursement will be a maximum of half the purchase price of the kitten. Shipping and transportation are not calculated in the purchase price nor does veterinary care, food, supplements, training, cleaning and all other cost of owning the kitten.
5. If the kitten is sold with breeding rights, we do not guarantee the cat to be able to reproduce.
Replacement Kitten Process
1. The Seller will notify the Buyer when a similar kitten is available. The Buyer will be given 72 hours to respond to Seller. If Buyer fails to accept the kitten, then the warranty is considered terminated and Seller is released of any further obligations to the Buyer.
2. If a similar kitten is not available, the Buyer will be given the opportunity to pick a kitten that is available or wait until the next available litter. Seller is released of any further obligation and Warranty is considered terminated if buyer refuses kitten.
3. Replacement kitten must be picked up within 7 days of acceptance or go home date.
There is no guarantee on retired breeders from Coontastic Paws.
Forms of payment accepted for deposit: Venmo Friends, Money Order or Cash
Forms of payment accepted for pickup of kitten: Cash at Pickup unless other arrangements have been made prior to pickup
Legal disputes over this contract will be held in court chosen by the breeder and paid for by the buyer. Any violation of this contract by the Buyer will be grounds for legal proceeding initiated by the Seller and may result in forfeit and return of the kitten/cat, dependent on the finding of a Judge within the jurisdiction of the Seller.
Severability: If any provision, section or part of this Agreement is deemed illegal, invalid or unenforceable by a court of competent jurisdiction, that portion of the Agreement may be severed and shall not affect the validity or enforceability of the remaining portions of this Agreement in that jurisdiction.
